Terms of Use

Effective September 10, 2026

The rules for using Pouch, connecting assistants, and managing your portable memory vault.

1. Agreement

These Terms of Use ("Terms") are an agreement between you and Roscommon Group LLC ("Pouch", "we", or "us"). By downloading, accessing, or using Pouch, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Pouch. Apple's Standard Licensed Application End User License Agreement also applies. These Terms supplement it and do not limit rights that cannot lawfully be limited.

2. What Pouch provides

Pouch provides software for storing user-controlled documents in a private iCloud database and for granting authorized third-party assistants deterministic file access through a remote gateway. Pouch does not provide an AI model, generate advice, decide what is true, or control how a connected assistant reasons about or uses information it receives.

Features, supported assistants, installation methods, and read or write capabilities may vary by platform, region, account, plan, or third-party policy. Beta features may be incomplete, unavailable, or change without notice.

3. Eligibility and accounts

You must be legally permitted to use Pouch and to enter this agreement. Pouch does not create a separate username or password; it relies on your Apple account and the accounts you choose to connect. You are responsible for securing those accounts, devices, recovery methods, and credentials, and for activity authorized through them.

Pouch is not directed to children under 13. If you are under the age of legal majority where you live, use Pouch only with permission and supervision of a parent or legal guardian.

4. Your content and instructions

You retain ownership of content you place in your vault. You grant us a limited, worldwide license to process that content only as needed to operate, secure, support, and improve the functionality of Pouch at your direction. This license ends when the content is deleted, except for transient copies and retention required by law.

You are responsible for your content, its accuracy, your instructions to assistants, and ensuring that you have permission to store and disclose it. Do not store passwords, private keys, authentication codes, payment-card data, protected health information, highly regulated records, illegal content, or information you are not authorized to disclose. Pouch is not designed as a credential manager, medical-record system, legal-record system, or regulated records archive.

5. Connected assistants and third parties

Apple, iCloud, Cloudflare, and each connected assistant are independent third-party services governed by their own terms and policies. When you authorize an assistant, you instruct Pouch to disclose requested vault information to that provider and, if write permission is granted, to accept changes from it. Assistant output and tool use can be incomplete, inaccurate, unexpected, or harmful. Review important changes and maintain exports appropriate to your needs.

We are not responsible for the models, content, acts, omissions, availability, security, retention, pricing, or policy changes of third parties. A connection or compatibility statement does not mean that a provider sponsors or endorses Pouch.

6. Acceptable use

You may not use Pouch to violate law or another person's rights; distribute malware; abuse, probe, or bypass security or rate limits; obtain unauthorized access; interfere with other users or infrastructure; misrepresent identity or authority; automate excessive requests; or build a competing service by copying protected portions of Pouch. You may not use Pouch in a safety-critical system where failure could reasonably cause death, personal injury, severe property damage, or material legal or financial harm.

7. Backups, deletion, and availability

You are responsible for maintaining suitable exports and checking the results of important edits. Synchronization conflicts, provider outages, credential expiry, software defects, account loss, or assistant actions may cause delay, inconsistency, or data loss. Permanent deletion is destructive and may not be recoverable. We may change, suspend, limit, or discontinue Pouch or an integration, including to protect users or comply with law.

8. License, ownership, and feedback

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Pouch on Apple devices you own or control as permitted by Apple's usage rules. We own Pouch's software, original design, service, and branding; third parties retain their content and marks. Feedback may be used without restriction or compensation, but we do not claim ownership of your vault content.

9. No professional advice

Pouch and connected assistants are not substitutes for professional judgment. Do not rely on them for medical, legal, financial, tax, safety, emergency, or other high-stakes advice. Independently verify important information and decisions with qualified professionals.

10. Disclaimer of warranties

To the maximum extent permitted by law, Pouch is provided "as is" and "as available", without warranties of any kind, express, implied, or statutory.

This includes implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, security, quiet enjoyment, availability, synchronization, compatibility, or uninterrupted or error-free operation. We do not warrant connected assistants, third-party services, AI output, or the preservation or recoverability of content.

11. Limitation of liability

To the maximum extent permitted by law, Roscommon Group LLC and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss, corruption, disclosure, or unavailability of data; lost profits, revenue, business, opportunities, goodwill, or reputation; or replacement-service costs.

To the same extent, our total aggregate liability arising from or related to Pouch or these Terms will not exceed the greater of the amount you paid directly to us for Pouch during the 12 months before the event giving rise to the claim or USD $100. These limits apply regardless of legal theory and even if a remedy fails of its essential purpose. They do not exclude liability or rights that cannot lawfully be excluded or limited.

12. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless Roscommon Group LLC and its owners, officers, employees, contractors, and agents from third-party claims, damages, losses, liabilities, and reasonable legal fees arising from your unlawful use of Pouch, your content, your violation of these Terms, or your infringement of another person's rights. This section does not apply to the extent prohibited by consumer law or caused by our own unlawful conduct.

13. Suspension and termination

You may stop using Pouch and disconnect assistants at any time. We may suspend or terminate gateway access when reasonably necessary to address a security risk, unlawful or abusive use, a material breach, nonpayment if paid services are introduced, or a third-party or legal requirement. Terms that by nature should survive termination—including ownership, disclaimers, liability limits, and dispute provisions—will survive.

14. Disputes and governing law

Before filing a formal claim, contact Pouch Support with a description of the dispute and requested relief and allow 30 days for an informal resolution. These Terms are governed by Washington law, without regard to conflict-of-law rules. Any dispute not required by applicable law to be heard elsewhere will be brought in the state or federal courts located in King County, Washington. Mandatory consumer rights in your home jurisdiction remain unaffected.

15. General

If a provision is unenforceable, it will be modified only as much as necessary and the remainder will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or sale. We are not liable for delay or failure caused by events beyond our reasonable control. These Terms and incorporated policies are the entire agreement concerning Pouch.

16. Changes and contact

We may update these Terms by posting a revised version and changing the effective date. If a change materially reduces your rights, we will provide additional notice when required. Continued use after revised Terms take effect constitutes acceptance to the extent permitted by law.
