Terms of Use

1. Agreement

These Terms of Use ("Terms") are an agreement between you and Roscommon Group LLC ("HN Relay", "we", or "us"). By downloading, accessing, or using HN Relay, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the app. Apple's Standard Licensed Application End User License Agreement also applies; these Terms supplement it and do not limit rights that cannot lawfully be limited.

2. What HN Relay is

HN Relay is an independent interface for browsing public Hacker News stories, comments, and linked websites. We may change, suspend, or discontinue any part of the app at any time. The app is provided for general information and entertainment, not as professional, financial, medical, legal, security, or other advice.

3. Independent service and third-party content

HN Relay is not affiliated with, endorsed by, or sponsored by Y Combinator or Hacker News. Story titles, comments, scores, authors, websites, images, and other materials come from third parties. We do not create, pre-screen, verify, endorse, or control that content. It may be inaccurate, offensive, unlawful, insecure, unavailable, or unsuitable. You access and rely on third-party content at your own risk.

4. External websites

Links open websites operated by others. We are not responsible for their content, availability, security, privacy practices, products, transactions, or conduct. A link or preview does not imply endorsement. Review a site's terms and privacy policy before interacting with it or providing information.

5. License and acceptable use

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control as permitted by Apple's usage rules. You may not misuse the app, interfere with its operation, bypass security or technical limits, introduce malicious code, infringe another person's rights, or use the app in violation of law.

6. Tips and purchases

Tips are optional consumable in-app purchases handled by Apple. They do not unlock content, features, or service levels. Pricing, payment, taxes, refunds, and purchase processing are subject to Apple's terms and policies. Except where law or Apple's policies require otherwise, completed tips are final.

7. Ownership and feedback

We own HN Relay's software, original design, and branding. Third parties retain all rights in their content and marks. If you provide feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use it without restriction or compensation.

8. No warranties

To the maximum extent permitted by law, HN Relay is provided "as is" and "as available" without warranties of any kind, express, implied, or statutory.

This includes warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, security, availability, or uninterrupted or error-free operation. We do not warrant any story, comment, preview, link, website, download, advice, or other third-party material.

9. Limitation of liability

To the maximum extent permitted by law, Roscommon Group LLC and its owners, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, goodwill, reputation, device availability, or security.

These limits apply to claims arising from or related to the app, third-party content, external websites, or these Terms, even if advised of the possibility. To the same extent, our total aggregate liability for all claims will not exceed the greater of the amount you paid directly to us for the app during the preceding 12 months or USD $100. Some jurisdictions do not allow certain exclusions or limits, so part of this section may not apply to you.

10. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless Roscommon Group LLC and its owners, officers, employees, and agents from claims, damages, losses, liabilities, and expenses, including reasonable legal fees, arising from your misuse of the app, violation of these Terms or law, or infringement of another person's rights.

11. Apple

Roscommon Group LLC, not Apple, is responsible for the app and its support, subject to Apple's terms. Apple has no obligation to provide maintenance or support. To the extent required by applicable terms, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Disputes and governing law

Before filing a formal claim, contact us and allow 30 days to attempt an informal resolution. These Terms are governed by Washington law, without regard to conflict-of-law rules. Any dispute not required by applicable law to be heard elsewhere will be brought in the state or federal courts located in King County, Washington. Mandatory consumer rights in your home jurisdiction remain unaffected.

13. General

If a provision is unenforceable, it will be modified only as much as necessary and the remainder will stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, or sale. We are not liable for delay or failure caused by events beyond our reasonable control.

14. Changes and contact

We may update these Terms by posting a revised version and changing the effective date above. Continued use after an update takes effect constitutes acceptance to the extent permitted by law. Questions may be sent using the contact information below.
